1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of the Hey, Jude website, technology, and non-clinical services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Platform.
2. Operator and Legal Entity
The Platform is operated by Hey, Jude ("Hey, Jude," "we," "us," or "our"). The full legal operating entity is identified in our published company information once finalized. Questions may be directed to support@heyjude.com.
3. Eligibility
The Platform is intended solely for individuals who are at least 18 years of age and located in areas where the services are available. By using the Platform, you represent that you meet these requirements. We may suspend or terminate access where we believe these requirements are not met.
4. Account Registration
You may need to create an account to use certain features. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account, and you agree to provide accurate, current, and complete information and keep it updated. Notify us promptly of any unauthorized use.
5. Hey, Jude's Non-Clinical Role
Hey, Jude provides non-clinical technology, administrative, and coordination services. Hey, Jude does not practice medicine, prescribe or dispense medication, ship medication, operate as a pharmacy, or sell medical supplies. Hey, Jude is a management services organization and technology platform; it is not a medical practice, a pharmacy, or a merchant or shipper of treatments or medical supplies.
6. Independent Healthcare Professionals
Independent licensed healthcare professionals evaluate users and make all medical decisions, including whether treatment is appropriate and whether to issue a prescription. Any clinical relationship is between you and the treating professional, not Hey, Jude.
7. Independent Pharmacies
When treatment is prescribed, an independent licensed pharmacy is responsible for dispensing, fulfillment, and shipment. Each dispensing pharmacy is responsible for its own preparation, dispensing, fulfillment, quality, and shipment obligations.
8. Third-Party Payment and Fulfillment Partners
Treatment-related transactions, dispensing, and fulfillment are completed through the applicable third-party partners. Your use of any third-party payment, dispensing, or fulfillment service may be subject to that partner's own terms and privacy practices.
9. No Medical Advice from Hey, Jude
Nothing on the Platform from Hey, Jude constitutes medical, clinical, or professional advice. Information provided by Hey, Jude is general and for informational purposes only. For medical questions, treatment decisions, or side effects, contact your treating healthcare professional.
10. No Guarantee of Treatment
Completing an assessment does not guarantee treatment. Whether treatment is appropriate, and whether to prescribe, is determined solely by an independent licensed healthcare professional. Hey, Jude does not approve, prescribe, or guarantee any treatment, prescription, or outcome.
11. Emergency Disclaimer
For a medical emergency, call 911 or seek immediate medical care. Do not use the Hey, Jude website, support email, or messaging tools for a medical emergency.
12. Accurate Information
You agree to provide accurate and complete information during intake and account use, and to keep it current. Clinical and fulfillment decisions made by independent professionals and pharmacies may rely on the information you provide.
13. Communications
By using the Platform, you agree that Hey, Jude may send you administrative and account-related communications, including notifications relating to your account status or information received from the applicable third-party partners. Marketing communications are sent only where separately permitted, and you may opt out. SMS communications are also governed by our SMS Terms.
14. Platform Use
You agree to use the Platform only for lawful purposes. You will not violate any applicable law; misrepresent your identity, age, or eligibility; interfere with or disrupt the Platform or its security; or attempt to gain unauthorized access to any system.
15. Third-Party Services and Links
The Platform relies on and links to third-party services, including independent clinicians, independent pharmacies, payment processors, and fulfillment partners. We are not responsible for the content, policies, acts, or omissions of third parties, and your use of third-party services is subject to their terms.
16. Fees and Payment-Policy Reference
Charges that may apply, how recurring treatment charges work, cancellation, and refunds are described in our Payment, Recurring Charges, Cancellation, and Refund Policy, which is incorporated by reference. Hey, Jude is not the seller of medication or medical supplies.
17. Intellectual Property
The Platform and its content, including text, graphics, logos, the "Hey, Jude" name and marks, and software, are owned by or licensed to Hey, Jude and protected by intellectual-property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission, except as permitted for ordinary personal use of the Platform.
18. Privacy
Our collection and use of information is described in our Privacy Policy. Please review it to understand how information is handled and shared with independent clinicians, pharmacies, and other third-party partners involved in providing requested services.
19. Acceptable Use
You will not use the Platform to transmit unlawful, infringing, or harmful content; to harass or harm others; to circumvent eligibility or security controls; or in any manner that could damage, disable, or impair the Platform.
20. Disclaimer of Platform Warranties
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Platform will be uninterrupted, error-free, or secure. Hey, Jude does not warrant or guarantee any medication, compounded product, clinical service, or pharmacy operation, each of which is the responsibility of the applicable independent professional or pharmacy.
21. Limitation of Liability
To the fullest extent permitted by law, Hey, Jude and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of the Platform or from the acts or omissions of independent clinicians, pharmacies, or other third-party partners. Our aggregate liability for any claim relating to the Platform will not exceed the amount of platform or administrative fees, if any, you paid to Hey, Jude in the twelve months preceding the claim.
22. Indemnification
You agree to indemnify and hold harmless Hey, Jude from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Platform, your violation of these Terms, or your violation of any law or the rights of any third party.
23. Governing Law
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws principles.
24. Dispute Resolution
Any dispute arising out of or relating to these Terms or the Platform will be resolved in the state or federal courts located in Utah, and you consent to their jurisdiction.
25. Electronic Records and Signatures
By creating an account or otherwise using the Platform, you agree to receive disclosures, notices, agreements, and other records electronically rather than in paper form, and to conduct transactions and sign documents electronically. You may withdraw this consent at any time by contacting support@heyjude.com, though withdrawal may limit your ability to use the Platform. You may request a paper copy of a record by contacting us, and should retain a copy of any record you wish to keep. Viewing electronic records requires a device and software capable of accessing, downloading, and printing standard electronic documents (such as PDF files).
26. Changes
We may update these Terms from time to time. Changes are effective when posted with an updated effective date. Your continued use of the Platform after changes constitutes acceptance.
